The Colombian Civil Code regulates the theory of risk in the contractual relationships that arise from the sale. The buyer is not the owner and bears the fortuitous loss of the thing, having to execute the payment provision knowing that the debtor will not meet theirs, in a situation that threatens the contractual balance of act. The theory is taken from French law, George Ripert (n. d) and adopted by the Colombian law. It is proposed that the cause of the (...) contract, element of formation, and execution of the act is accepted in order to restrict the threat that puts the legal stability of the act at risk. En este texto argumento a favor de la consideración de la forma como sujeto y, por tanto, como responsable de la identidad del objeto a través del movimiento. Se consideran sucesivamente la prioridad de la forma como sustancia, su carácter particular y los distintos sentidos en los que algo puede ser sujeto, para concluir por qué en Z, 3, la forma es el mejor candidato no sólo para ser sustancia, sino para ser sujeto en sentido principal. El objeto del texto (...) es abordar la discusión en torno a por qué la forma satisface ontológicamente mejor que la materia o el compuesto el criterio de ser sujeto y las consecuencias filosóficas de esa postura. A partir de un enfoque filosófico interpretativo, este texto tiene por objetivo estudiar los alcances y limitaciones del modelo de lectura crítica propuesto por el Ministerio de Educación Nacional de Colombia. Para abordar lo anterior, en primer lugar, se estudia cómo están diseñadas las pruebas de lectura crítica y qué significa interpretar un texto; en segundo lugar, se analiza la importancia de la lectura crítica para el fomento de la sabiduría práctica, y, en tercer lugar, se responde por qué es (...) importante concebir la lectura como experiencia formativa desde perspectivas creativas y plurales. El amor es sentimiento, afecto, inclinación y entrega a alguien, mientras que la obsesión es una perturbación anímica producida por una idea fija. Sentimiento y perturbación son cosas distintas y producen comportamientos bien diferentes. Sin embargo, el amor puede experimentarse como una idea con tenaz persistencia y como un deseo incontrolable.

Propósito: la adecuación del esfuerzo terapéutico es una decisión clínica basada en la evidencia que pretende evitar la futilidad médica. Se han señalado diferentes factores que pueden influir en esta toma de decisiones los cuales se relacionan con el paciente, el profesional médico que toma de las decisiones, barreras del sistema, cultura y economía, entre otros. El presente estudio pretende identificar aquellos factores que influyen en los médicos especialistas que laboran en la institución referente del cáncer en Colombia, a fin (...) de planear acciones que mejoren el abordaje de la toma de decisiones con respecto a la adecuación del esfuerzo terapéutico en pacientes con cáncer. Metodología: diseño cualitativo basado en 13 entrevistas en profundidad a médicos especialistas del Instituto Nacional de Cancerología de Colombia. Resultados: participaron 3 mujeres y 10 hombres, con un promedio de edad de 36 años, 7 pertenecientes a la especialidad de oncología de adultos, 2 a oncohematología pediátrica, 1 a cuidados intensivos de adultos y 3 a cuidados intensivos pediátricos. Los factores hallados se agruparon en cuatro categorías: 1) conocimiento, 2) aspectos relacionados con la toma de decisiones, 3) quién decide, 4) tipo de decisión que se toma; a su vez, estas categorías se agruparon en temas que hacen alusión a los factores que influyen en la toma de decisiones de los especialistas para adecuar los esfuerzos terapéuticos. Conclusión: la adecuación de los esfuerzos terapéuticos es importante para evitar procedimientos médicos fútiles que prolonguen el sufrimiento. Se evidenciaron algunos factores que influyen en la toma de decisiones de los especialistas: falta de preparación de los profesionales de salud en el tema de toma de decisiones al final de la vida, uso reducido de escalas que permitan mejorar la información del pronóstico y desconocimiento sobre voluntades anticipadas; estos son algunos de aquellos factores que deben fortalecerse para generar acciones que mejoren el abordaje de esta temática. En este artículo se presenta la importancia que le da Hannah Arendt al relato histórico y ficticio como vía para la reflexión ética y política. Se estudia, en primer lugar, cómo los relatos posibilitan la configuración de la identidad, tanto de un hombre como de una comunidad, ya que la narración permite dar sentido a la fragilidad y contingencia propia de las acciones humanas. En segundo lugar se analiza de qué manera la narración permite conservar en la memoria acciones para (...) que no sean olvidadas. Finalmente se estudia cómo el seguimiento de relatos contribuye a la comprensión del mundo humano y a potenciar la facultad de juzgar para superar pensamientos solipsistas, elemento necesario para el ejercicio de una concepción ética y política basada en el reconocimiento de la pluralidad humana. The negative impacts of agriculture on the environment and the inequity that limits access to healthy food for the entire population impede sustainable development. This article reflects contributions to food security and alternatives for transitioning to sustainable food systems. It is concluded that food, as a human right, is a complex and transdisciplinary issue, which must be integrated as a transversal axis in the economic, social, environmental, governance, and cultural dimensions to contribute to sustainable development and therefore the convenience of (...) making the transition from the concept of food security to that of food sustainability. The Lasallian District of Medellin, Colombia requested Corporación Universitaria Lasallista to analyze the formation process received by postulants to De La Salle Brothers in Istmina, Colombia, from 2002 to 2010. Academic, religious, pedagogical, apostolic and personal formation experiences received there were analyzed in this case study –from a qualitative approach– by means of semi-structured interviews and focus groups. Personal and apostolic formations stand out among the results due to the characteristics of Istmina as a proper place for sensibilization and subjugation (...) in proof of vocation. However, the reach of integral formation is questioned because academic formation presented meaningful deficiencies. In conclusion, even though formation experiences in vulnerable contexts are appreciated –and contextualization of learning is deemed meaningful–, participants agree in the necessity of developing strong competences to face educational and apostolic practices. In the intellectual scene of 19th century Colombia, Soledad Acosta de Samper stands out for pioneering the recognition of the significance of women for society. This purpose can be found in her work as a journalist as well as in her essays and literary works. Thus, the aim of the article is to analyze from the standpoint of social criticism how are configured the female characters in the works Dolores: cuadros de la vida de una mujer y Teresa la limeña: (...) páginas de la vida de una peruana. Based on the analysis of these novels, the article seeks to show how she gives voice to the main characters of her work, thus looking into the intimacy of female thinking. With the latter, she not only contributed to the strengthening of the ideals of virtue fostered during 19th century, but also of the necessity of intellectual education of women as a fundamental requirement for the training of ideal female citizens. Biobased production has been promoted as a sustainable alternative to fossil resources. However, controversies over its impact on sustainability highlight societal concerns, value tensions and uncertainties that have not been taken into account during its development. In this work, the consideration of stakeholders’ values in a biorefinery design project is investigated. Value sensitive design is a promising approach to the design of technologies with consideration of stakeholders’ values, however, it is not directly applicable for complex systems like biorefineries. Therefore, some (...) elements of VSD, such as the identification of relevant values and their connection to a technology’s features, are brought into biorefinery design practice. Midstream modulation, an approach to promoting the consideration of societal aspects during research and development activities, is applied to promote reflection and value considerations during the design decision making. As result, it is shown that MM interventions during the design process led to new design alternatives in support of stakeholders' values, and allowed to recognize and respond to emerging value tensions within the scope of the project. In this way, the present work shows a novel approach for the technical investigation of VSD, especially for biorefineries. Also, based on this work it is argued that not only reflection, but also flexibility and openness are important for the application of VSD in the context of biorefinery design. (shrink)

Gray zones, which develop wherever oppression is severe and lasting, are inhabited by victims of evil who become complicit in perpetrating on others the evils that threaten to engulf themselves. Women, who have inhabited many gray zones, present challenges for feminist theorists, who have long struggled with how resistance is possible under coercive institutions. Building on Primo Levi's reflections on the gray zone in Nazi death camps and ghettos, this essay argues that resistance is sometimes possible, although outsiders are rarely, (...) if ever, in a position to judge when. It also raises questions about the adequacy of ordinary moral concepts to mark the distinctions that would be helpful for thinking about how to respond in a gray zone. (shrink)

Abstract:During recent years, the principle and practice of employment-at-will have been under attack. While progress has been made in eroding the practice, the principle still governs the philosophical assumptions underlying employment practices in the United States, and, indeed, EAW has been promulgated as one of the ways to address economic ills in other countries. This paper will briefly review the major critiques of EAW. Given the failure of these arguments to erode the underpinnings of EAW, we shall suggest new avenues (...) for approaching employment issues to achieve the desirable goal of employee dignity and respect. This article presents a response to Richard Rorty's paper "Is Philosophy Relevant to Business Ethics?" The author questions Rorty's views on the depreciation of the role of philosophy in applied ethics, and outlines four reasons why philosophy retains its relevance. The author addresses the role of moral reasoning in the development of the moral imagination. The author also concludes that humans have the means necessary to make moral progress and are capable of moral reasoning, and need only to develop a (...) strong moral imagination. (shrink)

Das ethische Prinzip des Respekts vor der Autonomie des Patienten/Probanden hat in der modernen Medizin mittlerweile weltweit Bedeutung erlangt. Die Betonung der Autonomie des Patienten und Probanden in allen in der letzten Zeit verabschiedeten internationalen Deklarationen gibt dieser Tendenz unmissverständlich Ausdruck. Doch wenngleich diese Entwicklung unstrittig positiv ist, wirft sie dennoch eine Reihe von Fragen auf, die mit der Kodifizierung, Interpretation, Reichweite und Anwendung dieses universalen Prinzips verbunden sind. Die Antworten auf diese Fragen entscheiden darüber, ob Autonomie als hilfreiches, emanzipatorisches (...) oder als überforderndes, gar hegemoniales Prinzip begriffen wird. Diese normativen Probleme werden anhand von Beispielen aus der globalen Medizinethik verdeutlicht. Was in modernen Gesellschaften als Autonomie bezeichnet und für die Praxis fruchtbar gemacht wird, ist als ein soziales Konstrukt zu verstehen, nicht im Sinne einer Schimäre, sondern im Sinne einer soziokulturellen Leistung, die auf komplexen, historisch gewachsenen und kulturell geprägten Interaktionen von Gesellschaften, Institutionen und Individuen beruht. ABSTRACT In Mexico informed consent is a legal requirement that ensures that patients who are invited to participate in clinical trials are provided with all the information needed to decide whether to participate, or not, in a research protocol. To improve our understanding of the problems physicians in developing countries encounter, when obtaining informed consent (IC), we examined their opinion on the importance of IC in clinical research, the quantity and quality of the information provided to the participant, and the (...) conditions in which the IC is obtained. Investigators considered that IC was useful to the patients, providing information that helped the patient to make a decision about his/her participation. Nevertheless, they felt that for some aspects of the research, like drug development in general, the use of placebos, and the randomization process, many of the patients were not capable of fully understanding the information provided, referring to the complexity of the information and illiteracy as the main reasons. Many investigators were not acquainted with some of the guidelines established in the Mexican General Law of Health,1 36% of them admitting to not having completed their IC letters. Most investigators gave only minutes to the patient to make a decision and 20% of ICs were obtained while the patient was hospitalized. Except for one investigator, all of them considered that specific training in medical ethics would be useful for the daily clinical work. (shrink)

The editorial introduces issue 21.1 of Technoetic Arts via a critical reflection on the artificial intelligence hype (AI hype) that emerged in 2022. Tracing the history of the critique of Large Language Models, the editorial underscores that there are substantial ethical challenges related to bias in the training data, copyright issues, as well as ecological challenges which the technology industry has consistently downplayed over the years. -/- The editorial highlights the distinction between the current AI technology’s reliance on extensive pre-existing (...) human-generated data for pattern recognition and the performative process inherent in art practice. Patterns of creative output can be replicated without a thorough understanding of underlying concepts. In contrast, the performative process of art practice, as explored through the conceptual frameworks of creativity by Noam Chomsky, Charles Sanders Peirce, and Roger T. Ames and with reference to an earlier publication of the editorial’s author, creates concepts and continually ‘strives to extend itself towards the unknown.’ -/- Following this introductory section, the editorial provides an overview of the ten articles featured in this issue of Technoetic Arts. The first four texts engage with emerging technologies from various perspectives in art and design. The subsequent six articles, part of a special section titled 'Perspectives from Chandigarh,' reflect a quest for meaningful existence within colonial, patriarchal, and biopolitical structures that frame everyday practices of exclusion and oppression.
